AccommodatED Academy — Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AccommodatED Pathways LLC ("AccommodatED Pathways," "we," "us," or "our"), which operates the AccommodatED Academy web application ("AccommodatED Academy" or the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please note: AccommodatED Academy is a supplemental tool for tutors and families. It does not replace a school's IEP/ARD process, a special- education evaluation, or the professional judgment of a qualified educator or clinician. See Sections 4 and 8.
1. Eligibility and accounts
- Tutors and administrators join either by invitation or by subscribing through our public signup, and must provide accurate registration information. Tutor and administrator accounts require two-factor authentication. You must be at least 18 years old to create a tutor or administrator account.
- Families (parents and legal guardians) join by claiming an access code provided by the student's tutor, and by giving the consent described in our Privacy Policy.
- Students do not create their own accounts. A student's information is entered by a tutor, and a parent or guardian must consent before it is used (see Section 6).
- You must be at least 18 years old to create a tutor, administrator, or family account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.
2. The Service
AccommodatED Academy helps tutors and special-education professionals:
- generate differentiated lessons and practice based on a student's grade, documented learning differences, and accommodations;
- track progress on IEP goals (for students with documentation) and on TEKS-aligned learning goals; and
- prepare progress reports for ARD meetings or family review.
We may change, add, or remove features over time. We will try to give reasonable notice of material changes that adversely affect you.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- upload or enter another person's information without the authority and any consent required to do so;
- attempt to access accounts, records, or data you are not authorized to access, or to defeat the Service's security or access controls;
- scrape, reverse-engineer, or build a competing product from the Service or its data; or
- interfere with or disrupt the Service or its infrastructure.
4. Tutor and professional responsibilities
If you use the Service as a tutor or special-education professional, you are responsible for:
- having the legal right and any necessary parental/guardian consent to enter and process a student's information, and for verifying a parent's or guardian's identity before linking a family account (as described in the Privacy Policy);
- the accuracy of the records you enter;
- exercising your own professional judgment — the Service is a supplemental aid, not a substitute for evaluation, instruction decisions, or the school's IEP/ARD process; and
- reviewing and approving any AI-generated content (including progress-report narratives) before relying on it or sharing it. You are responsible for any documentation you adopt, sign, or submit, including ARD documentation.
5. AI-generated content
The Service uses artificial intelligence to draft lessons, practice questions, and report narratives. AI-generated content:
- is provided to assist a qualified human, who must review it before use;
- may contain errors, omissions, or content that requires correction; and
- is not professional, clinical, medical, legal, or special-education advice.
You should not rely on AI-generated content without independent professional review. See our Privacy Policy (Section 7) for how we protect student data when using AI, including that we do not send student or family identifying information to the AI provider.
6. Privacy and student data
Our handling of personal information — including children's information under COPPA and education-record-style controls — is described in our Privacy Policy, which is incorporated into these Terms. As between you and us, student records belong to the family and the tutoring relationship; we process them as a service provider to deliver the Service. Parents and guardians may access, correct, or delete a student's information as described in the Privacy Policy.
7. Your content; license
You retain your rights in the information you enter ("Your Content"). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service and to provide it to you, and to share it with the service providers listed in our Privacy Policy for that purpose. We do not sell Your Content and do not use student data to train third-party AI models.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OR OTHER CONTENT WILL BE ACCURATE OR COMPLETE. THE SERVICE IS NOT A MEDICAL, CLINICAL, LEGAL, OR ACCREDITED EDUCATIONAL PROVIDER AND DOES NOT PROVIDE SUCH ADVICE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AccommodatED Pathways AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold harmless AccommodatED Pathways from claims and expenses arising out of (a) your misuse of the Service, (b) your violation of these Terms or applicable law, or (c) your entry or use of student or third-party information without the necessary rights or consents.
11. Fees, subscriptions, trials, and cancellation
Paid plans are offered to tutors and administrators (families are never charged). Fees are shown before you subscribe. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms. All fees are in US dollars and, where applicable, exclusive of tax, which is added at checkout.
- Subscriptions renew automatically. Paid plans are recurring: your plan renews at the end of each billing cycle (monthly unless stated otherwise) and your payment method is charged automatically until you cancel. The renewal amount is the then-current fee for your plan.
- Free trials. If your plan includes a free trial, we collect a payment method at signup. Unless you cancel before the trial ends, the trial automatically converts to a paid subscription and your payment method is charged the plan's fee. Your trial end date is shown in your billing settings.
- Cancellation. You may cancel anytime from your billing settings. When you cancel, your subscription stays active through the end of the billing cycle you have already paid for; access ends at the end of that cycle. We do not issue prorated refunds for the unused portion of a cycle. Annual plans (when offered) are non-refundable after 14 days from the annual charge date; cancellation stops renewal and access continues through the paid year.
- Founding rate. Founding pricing is a locked, reduced rate contingent on a continuous, active subscription. If you cancel, the founding rate is permanently terminated and cannot be reinstated; resubscribing is at standard pricing then in effect. It is tied to your account and is non-transferable. Founding rates are protected against increases except where our underlying AI-provider costs rise by more than 25% within any 12-month period, in which case a proportional adjustment may apply with 90 days' prior written notice.
- Failed payments. If a renewal payment fails, we may retry and, if it remains unpaid, suspend or downgrade paid features after a reasonable notice period.
- Students' practice (My Climb). Enrolled students' My Climb access is governed by the student-access grace terms and is not immediately terminated by a tutor's cancellation.
12. Suspension and termination
You may stop using the Service and request account closure at any time. We may suspend or terminate access for violation of these Terms, for security reasons, or as required by law. On termination, we handle data as described in the Privacy Policy (including archival, export availability, and deletion on request).
13. Changes to these Terms
We may update these Terms. If we make a material change, we will post the updated Terms and, where appropriate, ask you to re-accept them. Your continued use after an update means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas, except that either party may seek injunctive relief in any court of competent jurisdiction.
